NopartyotherthanthePeople'sRepublicofChinashallderiveanyrights fromtheLoanAgreementorhaveanyclaimtotheloanproceeds.    2.2PaymentfromtheproceedsoftheWorldBankLoanwill be limited togoodsproducedin,andservices supplied from, Switzerland and the membercountriesoftheWorldBankwhichhave commercial relations with China.    2.3AllcostsnotmetbytheIFILoanwillbe paid by the Employer fromfundsallocatedbytheGovernmentofChina. 3.EligibilityandQualificationRequirements    3.1Thistenderisopentoallpre-qualifiedtenderers from eligible sourcecountriesasdefinedunderthe"GuidelinesforProcurement"of theworldBank.    3.2Allgoodsandservicestobesuppliedunder this Contract shall havetheiroriginineligiblesourcecountries,andallexpenditures madeundertheContractwillbelimitedtosuchgoodsandservices.    3.3Theoriginofgoodsandservicesisdistinctfromthe nationality ofthetenderer.    3.4Tobe eligible for award of contract, tenderers shall have providedevidencesatisfactorytotheEmployeroftheireligibility underclause3.1above,andoftheircapabilityand adequacy of resources toeffectivelycarry out the Contract. To this end, the Employer and ____________companymay,atanytimepriortoawardofcontract, requesttendererstoamplifyorupdatepreviouslysubmittedprequalificationdata. AllTenderssubmittedshallincludethefollowinginformation:    (a)copiesoforiginaldocumentsdefiningthe constitution or legal status,placeofregistrationand principal place of business of the company,firmorpartnershipor,ifajointventure,ofeachpartytheretoconstitutingthetenderer;    (b)thequalificationsandexperienceofkey personnel proposed for administrationandexecutionoftheContract,bothonandoffsite,intheformatprescribedinScheduleV;    (c)majoritemsofconstructionalplantandequipmentproposedforuseincarryingouttheContractintheformatprescribedinScheduleIV;    (d)alistofproposedsub-contractorsin the format prescribed in ScheduleVI;    (e)informationregardinganycurrentlitigationinwhichthetendererisinvolved;    (f)thedetailsoftheconstructionmethodsproposed.    3.5Forthepurposes of sub-clause 3.4, tenderers who have been pre-qualifiedmayupdateandaugmenttheinformationsupplied with theirapplication for pre-qualification, and, in particular,  shall  give particularsofworkinhandatthedateoftendering.    3.6Tenderssubmittedbyajointventure of two or more firms as partnersshallcomplywiththefo
