DOI：10.13766/j.bhsk.1008−2204.2023.0210对法律规范的社会学观察—论卢曼早期法社会学思想泮伟江（北京航空航天大学法学院，北京100083）摘要：卢曼的法社会学有早期与晚期之分。卢曼晚期的法社会学通常被认为代表卢曼理论成熟时期的观点，因此在世界范围内得到了更加广泛的传播和借鉴。相较于此，卢曼早期的法社会学理论则在全球范围被普遍忽视。然而，卢曼早期法社会学理论具有不可被替代的理论价值和启发意义。卢曼早期法社会学理论可以分为内容和方法两个层面。就研究内容而言，卢曼早期法社会学理论最大的贡献是对法律规范作出了独树一帜的社会学描述，并从新达尔文演化理论的角度阐述了法律与社会共同演化的理论；就研究方法而言，锻造意义的概念作为意识系统和社会系统共同演化的机制和基础，等置功能比较的方法和现象学化的一般系统理论是卢曼早期法社会学方法论的特色与贡献。关键词：卢曼；早期法社会学；非规范视角的规范理论；等置功能主义；双重偶联性中图分类号：D90-052文献标志码：A文章编号：1008−2204（2023）03−0079−15SociologicalObservationofLegalNorms:OnLuhmann’sEarlyThoughtsontheSociologyofLawPANWeijiang（LawSchool,BeihangUniversity,Beijing100083,China）Abstract:Luhmann’sthoughtsonthesociologyoflawcanbedividedintotheearlythoughtsandthelatethoughts.Hislatethoughtsonthesociologyoflawisusuallyconsideredtorepresenthisideasinthematurestageofhistheory,sotheyhavebeenwidelyspreadandusedforreferencearoundtheworld.Incontrast,Luhmann’searlysociologicaltheoryoflawisgenerallyneglected.Actually,ithasirreplaceabletheoreticalvalueandenlighteningsignificance.Luhmann’searlysociologicaltheoryoflawconsistsoftwoparts:contentandmethod.Intermsofcontent,itsgreatestcontributionistheuniquesociologicaldescriptionoflegalnorms,andtheelaborationofthetheoryofco-evolutionoflegalsystemandsocietyfromtheperspectiveofneo-Darwinianevolutiontheory.Asforthemethod,theconceptofconstructingmeaning,whichisthemechanismandbasisfortheco-evolutionofconsciousnesssystemandsocialsystem,thecomparativemethodofequivalentfunctionismandthegeneralsystemtheoryofphenomenologyarethefeaturesandcontributiontothemethodologyofLuhmann’searlysociologicaltheoryoflaw.Keywo...
